Title
Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) Title 12, Chapter 12, Section 190 Subsection F (1) A MARIJUANA ESTABLISHMENT be hereby amended by the following:

- Striking part c. and inserting in its place: ‘for Marijuana Cultivator, 75-feet of any residential use, for all other Marijuana Establishments, 75-feet of any residential use unless the Special permit granting authority finds that: (1) the establishment does not directly abut any property with a residential use (2) the public entrance to the building is at least 50-feet from the property line of any residential use and (3) along any property line of the Marijuana Establishment closer than 75-feet to a residential use a screening fence exists or will be installed that prevents people and vehicles from passing through and (4) the use will not otherwise be more detrimental to the neighborhood;’
- Inserting at the end of part d. ‘however, notwithstanding the previous language, calculation of this buffer zone shall not consider the Northern Strand Trail or the right-of-way it runs through; provided that if the Marijuana Establishment immediately abuts the Trail, a fence exists or will be installed along the Trail that prevents the passage of people between the Marijuana Establishment and the Trail;’
