Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) 9.20.050 PROVISIONS APPLICABLE TO ALL WASTE is hereby amended by striking Subsections A, B, and C in their entirety and inserting the following in their place:

A.                     Fees: Fees for collection and disposal of residential and commercial waste by the city shall be as follows:

All such fees collected shall be placed into a Solid Waste Collection and Disposal Fund.

B.                     The Public Works Commission shall by October 1, 2028, and at least every two years thereafter and when the City enters into a new solid waste contract: (1) evaluate the City’s costs of collection and disposal of solid waste including necessary costs related to program management as well as education and enforcement of this ordinance, (2) develop a proposed update to the fee schedule, (3) hold a public hearing on the proposed fee schedule and (4) approve an updated fee schedule for the following calendar year. Such fee schedule shall not reduce the City’s property taz contribution towards solid waste collection and disposal costs below that appropriated in the Fiscal 2025 - 2026 budget without being approved by a referendum placed on the ballot of a previous municipal election.

C.                     Purchase of Approved Trash Bags and Annual Trash Tags Approved trash bags and Annual Trash Tags shall be made available through the Office of the City Treasurer and the Department of Public Works Office during regular business hours. Approved trash bags shall also be made available for resale to the public at retail and commercial establishments as determined by the Director of Public Works, provided that no retail or commercial establishment shall charge more than the scheduled cost for each approved trash bag. Subject to annual funding, the Mayor shall work with local anti-poverty and elderly service agencies to provide approved trash bags to qualified residents for the disposal of residential solid waste as outlined in this paragraph, provided that said resident is not receiving assistance towards such costs from any other source.
