Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) Title 3 REVENUE AND FINANCE is hereby amended by adding 3.05 SOLID WASTE ENTERPRISE FUND

3.05.01 Establishment
Ordained by a vote of the Malden City Council on September xx, 2026 with paper #___ adopting the local option of M.G.L. c. 44, s. 53F ½ to establish a Solid Waste Enterprise Fund beginning with the fiscal year FY2028 for the purpose of separately accounting for the revenues, expenditures, assets, liabilities, and retained earnings associated with the City's solid waste management program.
3.05.02 Services and Activities
The Solid Waste Enterprise Fund shall include, but not be limited to, the following municipal services and activities:
• Residential solid waste collection;
• Recycling collection and processing;
• Yard waste and seasonal collection programs;
• Bulk waste collection and disposal;
• Household hazardous waste programs;
• Collection container acquisition and maintenance;
• Solid waste disposal and tipping fees;
• Contracted collection services;
• Equipment replacement and capital purchases associated with the solid waste program; and
• Any other costs or revenues directly attributable to the City's solid waste management system.
3.05.03 Fees and Charges To be Deposited
All user fees, service charges, grants, reimbursements, proceeds from the sale of recyclable materials, host community payments related to solid waste operations, fines, and any other revenues generated by or appropriated for the operation of the Solid Waste Enterprise Fund shall be deposited into said fund.
3.05.04 Authorized Expenditures
Expenditures from the Solid Waste Enterprise Fund shall be made only for costs reasonably related to the operation, maintenance, repair, replacement, administration, enforcement, debt service, capital improvements, and long-term financial sustainability of the City's solid waste management system, in accordance with Massachusetts General Laws Chapter 44, Section 53F½.
3.05.05 Operating Surplus to Remain
Any annual operating surplus remaining within the Solid Waste Enterprise Fund shall remain in the Enterprise Fund as retained earnings and shall not revert to the General Fund except as authorized by Massachusetts General Laws Chapter 44, Section 53F½.
3.05.06 User Fees to be Established Separately
The establishment of this Enterprise Fund shall not, by itself, establish or modify any user fee or solid waste collection charge. Any fees or charges shall be established separately by the Mayor and City Council in accordance with applicable law.
