Title
Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) Title 12 and 9 are hereby amended by the following as is outlined in the body of this paper:
Body
1. Inserting into MCC 12.12.030 USE REGULATIONS Residential Kitchens/Cottage Food Operations under the Residential category. Enter SPR in zones A, B, C, RO, BN, BC, BH, I1, I2; and
2. Inserting into MCC 12.28.030 HOME OCCUPATIONS Residential Kitchens/Cottage Food Operations
a) Operations shall be conducted entirely within the dwelling unit;
b) Only residents of the dwelling unit may engage in operation;
c) The use shall not generate traffic beyond normal residential levels;
d) On-site sales shall be limited to pre-arrange pickup;
e) The residential character of the property shall be maintained;
f) All operations shall comply with Board of Health permitting requirements.
3. Inserting into MCC 12.32.060 DEFINITIONS - ZONING the following definition:
Residential Kitchen / Cottage Food Operation:
A home occupation conducted within a dwelling unit involving the preparation of non-potentially hazardous food for direct sale to consumers, in compliance with 105 CMR 590 and regulations of the Malden Board of Health; and
Be it further ordained by the Malden City Council that the Code of the City of Malden (MCC) Title 9 is hereby amended by adding 9.10 RESIDENTIAL KITCHENS as follows:
A. Residential Kitchens are permitted within the City subject to regulation by the Board of
Health in accordance with Massachusetts Sanitary Code 105 CMR 590.001(c)
B. No person shall operate a Residential Kitchen without a permit issued by the Board of Health
C. Only non-potentially hazardous foods shall be produced, such that consumable products are not time or temperature controlled for safety.
D. The Board of Health may inspect such operations prior to approval and periodically
thereafter.
