Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) 9.20.050 PROVISIONS APPLICABLE TO ALL WASTE is hereby amended by striking Subsections A, B, and C in their entirety and inserting the following in their place:

A. Fees: Fees for collection and disposal of residential and commercial waste by the city shall be as follows:
1. Fee Schedule until December 31, 2026:
Approved 35 Gallon trash bag
$2.00 ea.
Approved 15 Gallon trash bag

Annual Trash Tag
$75 (prorated)
White Goods (residential customers only)

Multi-family Residential Disposal Surcharge
$50 per unit fee annually
applicable to non-owner occupied buildings of 6 units or less

All such fees collected shall be placed into a Solid Waste Collection and Disposal Fund.
B. The Public Works Commission shall by October 1, 2028, and at least every two years thereafter and when the City enters into a new solid waste contract: (1) evaluate the City's costs of collection and disposal of solid waste including necessary costs related to program management as well as education and enforcement of this ordinance, (2) develop a proposed update to the fee schedule, (3) hold a public hearing on the proposed fee schedule and (4) approve an updated fee schedule for the following calendar year. Such fee schedule shall not reduce the City's property taz contribution towards solid waste collection and disposal costs below that appropriated in the Fiscal 2025 - 2026 ...
