The Standing Committee on Ordinance, to whom was referred Papers #53 and #107 Series of 2014, having considered the same make the following report:  
 
Committee reports the following draft language on Paper #53 without recommendation:
Ordered: That the City submit to the Massachusetts legislature in substantially the following form:
AN ACT RELATIVE TO THE COLLECTION OF SOLID WASTE IN THE CITY OF MALDEN.
 
Be it enacted, etc. as follows:
 
Section 1. Notwithstanding any provision of special or general law to the contrary, fees for the collection of solid waste by the city of Malden or its agents and employees shall not exceed $2.00 for removal of a 33 gallon trash bag; provided that nothing herein shall prohibit the city from providing for removal of trash in bags of different volumes for proportionally equivalent fees.
 
Section 2. This act shall take effect upon passage.
 
Committee further reports the following draft language on Paper #107 without recommendation:
 
Be it hereby ordained by the Malden City Council that Section 9.28C1 of the Revised Ordinances of  1991 be and the same are hereby amended as follows:
-by adding a new section as follows:
Section 1.1: Any increase or decrease to the cost of approved trash bags as described in this chapter, shall not take effect until approved by a simple majority of those voting in a referendum on the ballot at the next municipal general election.
