Order: That the City take by eminent domain the property located at 794-838 Eastern Ave. for use as a police station.

ORDERED: That the Mayor be authorized to execute on behalf of the City of Malden an order of taking under which the City would acquire  in fee simple a certain parcel of land, together with the improvements thereon, known as and numbered as 794-838 Eastern Avenue in  Malden, Massachusetts, as further described in a deed dated Feb. 8, 2013, and recorded in the Middlesex South District Registry of Deeds Book 61168, Page 168; said taking is for purposes of construction of a municipal building intended as the Malden Police Department. The Property intended for acquisition comprises approximately 73,757.96 square feet of land, and is supposed to be owned by Gregory T. Antonelli, pursuant to deed recorded February 8, 2013 with the Middlesex South Registry of Deeds in Book 61168, Page 168.

Such order of taking shall be subject to such other conditions or restrictions as the Mayor may deem necessary and appropriate. Such order of taking shall provide an award of damages and relocation payments for the landowner not to exceed ($3,400,000.00) Three Million Four Hundred Thousand dollars.

The Mayor shall be authorized to carry out a tenant relocation program related to the acquisition to the extent required by law, provided that any payments or expenditures required to satisfy such requirement shall be approved by the Malden City Council.
