Communication: Planning Board re: Paper 418-23 (Amendment of Section 12.08.010 ESTABLISHMENT of DISTRICTS and to amend Section 12.08.020 ZONING MAP to establish the MBTA Communities Multi-Family Overlay District (MCMOD) and Mandatory Mixed-use Overlay District (MMUD)

Dear Councilors:
On December 5, 2023, the Planning Board and City Council Ordinance Committee jointly held a public hearing regarding the above-referenced proposed amendments.
After the public hearing, on December 5, 2023, a majority of the Planning Board, namely, all nine members present, decided to recommend to the City Council the following:
1. Approval of the proposed amendments of Section 12.08.010 (Establishment of Districts) and Section
12.08.020 (Zoning Map).
2. Approval of the amendments of Section 12.12 (Use Regulations) as proposed and with the following clarifying language (underlined):
a) Section 1.C.2.a Permitted Uses in MCMOD
b) "Only those non-residential uses allowed in the underlying zoning district are allowed, and all non-residential uses shall be subject to the use regulations of the underlying zoning district."
c) Section 4.D.1.b. Site Plan Review Committee:
"City Councilor-at-large, designated by President of the City Council, or designee."
3. Approval of the proposed amendments of Section 12.32.060.B (Definitions).
4. Prepare legal description of all property/land that is the subject of the amendment and include with any amendment ordained.
For your reference, enclosed please find the Planning Report & Recommendation dated December 5, 2023 with attachments, which was presented at the public hearing.
Finally, please be advised, that, the state deadline for the City to enact zoning that complies with the MBTA Communities Zoning Law (M.G.L. c.40A, Section 3A) is December 31, 2023.
