Committee Report: Ordinance (Paper #334 Be it ordained that Chapter 12 of R.O. 1991 be amended relative to parking, open space, special permits and development mitigation)

Body

The Standing Committee on Ordinance, to whom was referred Paper #334 Series of 2016, having considered the same, make the following report: Committee recommends that this paper be reported out favorably with the following amendments:

1.                     That the amendment to Section 300.1.1 be deleted;

2.                     That Section 400.3 be amended as proposed; and that Section 400.8.3 be amended  as proposed and to add the following: All open space shall be pervious, visible to the public and a minimum of 50% shall be located in yard setback areas, where setbacks are required;

3.                     That Sections 300.13.2 and 500.2.8.2 be amended as proposed and to add the following: If parking requirements are reduced, the developer/owner shall contribute $2,000 annually for each space reduced to a City of Malden Parking and Traffic Mitigation Trust Fund to be used at the City’s reasonable discretion to mitigate future impacts on traffic and parking and/or for infrastructure improvements to parking and traffic systems;

4.                     That the following language be added: These amendments shall not apply to applications for building permits, special permits, variances or site plan review approval filed prior to the date of first publication of notice of the public hearing on this amendment, namely August 26, 2016”;

5.                     That the proposed amendment to Sections 300.1.4 and 700.1.3.1.1 relative to development mitigation be retained in Ordinance Committee for further investigation and discussion.
