Title
Be it ordained by the Malden City Council that the Code of the City of Malden (MCC) Title 9 is hereby amended by adding 9.10 RESIDENTIAL KITCHENS as follows:
Body
A. Residential Kitchens are permitted within the City subject to regulation by the Board of Health in accordance with Massachusetts Sanitary Code 105 CMR 590.001(c)
B. No person shall operate a Residential Kitchen without a permit issued by the Board of Health
C. Only non-potentially hazardous foods shall be produced, such that consumable products are not time or temperature controlled for safety.
D. The Board of Health may inspect such operations prior to approval and periodically thereafter.
E. Cottage Food Operations may only sell cottage food products which are prepackaged with an ingredient label. The product does not need to be analyzed by a laboratory to obtain an official ingredient list, but all ingredients must be listed in descending order of predominance by weight. If a prepared item is used in the recipe, sub-ingredients must also be listed in conjunction with 105 CMR 590.003 and FC 3-602.
F. Products may be sold directly to consumers, including through farmers markets and prearranged or online sales.
G. The Board of Health may establish reasonable permit fees.
H. The Board of Health may suspend or revoke permits for violations.
