Be it ordained that the R. O. 1991 be amended to provide for oversight and control of school custodians by the Department of Public Facilities.

Be it hereby ordained by the Malden City Council that the Revised Ordinances of 1991 as amended be and the same are hereby further amended as follows:
-by adding at the end of the first sentence of the third paragraph of Section 3.23 the following
phrase "...and, subject to funding, shall employ a sufficient number of persons to provide custodial services to all municipal buildings, including schools."
This Ordinance shall take effect on July 1, 2014.
Subject to negotiations with the appropriate collective bargaining unit, all custodial personnel now employed by the School Department shall, upon the effective date of this act, be transferred to the Department of Public Facilities without loss of pay and without change of rating, seniority, retirement or pension rights, or any other privileges accrued under any provision of law or ordinance as of the date of transfer.
