Be it hereby ordained by the Malden City Council that Chapter 12 of the R. O. of 1991 be amended relative to Adult Specialty Retail Sales for tobacco, alcohol, and marijuana.

To Amend §§300, 400, 500 & 800 of Chapter 12, Revised Ordinances of 1991 as Amended as follows:

SECTION 800.6 Definitions, amend to add the following:
Adult Specialty Retail Sales: A retail store that sells alcohol, marijuana, nicotine and/or tobacco; any products containing alcohol, marijuana, nicotine and/or tobacco; and/or any accessories, supplies and/or equipment related to the use of alcohol, marijuana, nicotine and/or tobacco or any products containing alcohol, marijuana, nicotine and/or tobacco. Adult Specialty Retail Sales may be a principal use and/or a use accessory to a new residential, institutional, business, industrial or other use, or an existing use legally existing or begun prior to the first publication of notice of the hearing on this amendment of the ordinance.
SECTION 800.6.2.36 Definitions, to amend as follows:
General Retail Sales: delete “general;” add: “specifically excluding Adult Specialty Retail Sales”
